The Federal Hemp Ban Hits December 11: What Texans Can Still Buy

If you've shopped for hemp in Texas this year, you already know the shelves keep shifting. 2026 has been the most turbulent year in Texas hemp history — and there's one more big date circled on the calendar: December 11, 2026, when a new federal definition of hemp takes effect nationwide. Here's the plain-English version of where things stand, what's changing, and what you can still legally pick up at the shop today.

Quick note from the mothership: we're a smoke shop, not a law firm. This is general information, current as of October 2026 — not legal advice. Rules are moving fast, and we'll keep this guide updated.

The short version

  • Delta-8, delta-10, THCP and THCA products (including THCA flower and pre-rolls) — already off the menu in Texas. The state reclassified them as controlled substances effective July 31, 2026.
  • Hemp-derived delta-9 gummies, drinks and tinctures (0.3% delta-9 or less by dry weight) — still legal in Texas right now for adults 21+.
  • December 11, 2026 — the new federal rule caps finished hemp products at 0.4 milligrams of total THC per container. A single 10 mg gummy is 25 times that. Most of today's delta-9 edibles and beverages won't qualify as federal "hemp" after that date.
  • Not affected: non-intoxicating CBD and CBG products, kratom, and every piece of hardware in the shop — glass, rigs, vaporizers, Puffco gear, accessories.

How we got here: the Texas side

Quick recap for anyone who hasn't been following along. In September 2025, Texas made selling cannabinoid vapes a criminal offense and ordered that consumable hemp only be sold to adults 21 and up. Then, on May 1, 2026, the Texas Supreme Court upheld the Department of State Health Services' authority to define THC isomers as controlled substances. DSHS published its definitions in July, and they took effect July 31, 2026 — making delta-8, delta-10, THCP and THCA Schedule I substances under Texas law. That's why THCA flower disappeared from every compliant shop in the state, ours included.

We covered that chapter in detail in our Texas hemp law guide and our delta-8 update, so we won't re-litigate it here.

What the federal change actually does

The bigger story is federal. Buried in the government funding bill signed in November 2025 was a full rewrite of the legal definition of hemp from the 2018 Farm Bill. Three changes matter for you:

  • Total THC, not just delta-9. Hemp is now measured by total THC including THCA, at 0.3% or less. The loophole that made "THCA flower" a thing is closed at the federal level too.
  • Synthesized cannabinoids are out. Cannabinoids made outside the plant — like delta-8 converted from CBD — no longer count as hemp at all.
  • A hard cap on finished products. Consumable hemp products are limited to 0.4 mg of total THC per container. Not per serving — per container.

That last one is the quiet giant. A seltzer with 10 mg of delta-9, or a 10-pack of 10 mg gummies, is perfectly legal in Texas today — but after the deadline, it won't meet the federal definition of hemp anymore.

The rule was originally set to take effect November 12, 2026. The short-term funding extension passed in September 2026 pushed that back a month, to December 11, 2026. Could it move again, or get softened by FDA guidance or a court challenge? Possibly — the FDA is still required to publish its official cannabinoid lists, and industry lawsuits are widely expected. But as of today, December 11 is the date on the books.

What this means for your stash

Between now and December 11: hemp-derived delta-9 edibles, beverages and tinctures at or under 0.3% delta-9 remain legal to buy in Texas if you're 21+. If you have favorites, this is the window. Browse our hemp edibles and gummies, and keep an eye on the Last Chance — THC Ban Clearance collection, where we're marking down inventory ahead of the deadline.

After December 11: expect the legal hemp aisle to tilt toward products that fit under the 0.4 mg total-THC cap — mainly non-intoxicating CBD and CBG. One wrinkle worth knowing: a "full-spectrum" CBD product with trace THC can still blow past 0.4 mg per container, so broad-spectrum and isolate-based products are the safer long-term bet. Everything we stock in that lane is third-party tested — see our COA-verified hemp collection.

What's not changing at all

  • Kratom — it's a different plant entirely and isn't touched by hemp law. Our full kratom wall (powders, capsules, extracts and shots) isn't going anywhere.
  • CBD topicals, pet CBD and wellness products with little to no THC.
  • Hardware. Glass, bongs, dab rigs, dry herb vaporizers, torches, papers — none of it is regulated by these laws. And as an authorized Puffco dealer, we'll keep stocking the full Peak Pro, Pivot and Proxy lineup with warranty support, same as always.

FAQ

Is delta-9 still legal in Texas right now? Yes — hemp-derived delta-9 at 0.3% or less by dry weight is legal for adults 21+, and that's state law. The December 11 change is federal and affects what qualifies as "hemp" going forward.

Is THCA flower legal in Texas? No. Since July 31, 2026, Texas treats THCA as a Schedule I controlled substance. Compliant shops no longer sell it.

Will CBD stay legal? Non-intoxicating CBD products that fit under the new total-THC limits remain legal. Expect labels and formulations to shift toward broad-spectrum and isolate.
