Short answer: no — delta-8 is currently banned in Texas. After years of court battles, 2026 is the year the rules actually changed. If you've walked into a smoke shop lately and noticed the hemp shelf looks different, this is why. Here's the plain-English version of where things stand, what's still legal, and what it means for your next visit.
What changed in 2026
For five years, a 2021 court injunction kept delta-8 and similar hemp-derived THC products on Texas shelves. In May 2026, the Texas Supreme Court ended that injunction, and the Texas Department of State Health Services (DSHS) moved quickly: hemp-derived THC isomers — delta-8, delta-10, THC-P, HHC and friends — went back on the state's Schedule I controlled substances list.
On top of that, DSHS tightened how THC is counted. Under 25 TAC §300.101 (effective March 31, 2026), legal hemp must test at 0.3% or less of delta-9 THC and THCA combined, on a dry-weight basis. Because THCA converts to delta-9 when heated, that rule change is what took THCA flower off the "legal hemp" list — it now tests over the limit the moment THCA counts toward the total.
What's banned in Texas right now
- Delta-8 and delta-10 THC products — gummies, carts, tinctures, all of it
- THC-P, THC-O, HHC and other synthesized or converted cannabinoids
- THCA flower and pre-rolls — over the limit under the new total-THC math
- Vapes containing any cannabinoid — including CBD vapes, under Health & Safety Code §161.0876
Penalties aren't a slap on the wrist, either — possession of a banned cannabinoid can be charged as a state jail felony. Not worth it.
What's still legal (yes, there's good news)
Texas did not ban hemp. Products that stay under 0.3% delta-9 THC by dry weight are still legal to sell and buy — and because edibles and drinks are heavy, that dry-weight math allows a real serving of delta-9 in a gummy or a can. Still on our shelves, fully compliant:

Didn't a judge just rule on this?
Yes — and it didn't go the industry's way. Hemp retailers sued in federal court, arguing the Texas ban conflicts with the 2018 Farm Bill. On August 10, 2026, a federal judge in Galveston denied the industry's emergency request to block enforcement while the case plays out. A fuller preliminary-injunction decision is still pending, but as of today the ban is live and being enforced. We're watching the docket so you don't have to.
One more date to circle: November 12, 2026
This one's federal. A provision tucked into a 2025 spending bill (Section 781 of H.R. 5371) rewrites the federal definition of hemp effective November 12, 2026, excluding products with intoxicating levels of THC. Depending on how it's enforced, that could reshape the hemp market in every state — not just Texas. Translation: the era of loophole products is closing nationwide, and the brands that survive will be the compliant, lab-tested ones. Those are the ones we carry.
